1. Acceptance of Terms

By creating an account or using Trimsy ("the Service"), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Service. These Terms apply to all users, including salon owners, staff members, and customers.

2. Description of Service

Trimsy is a queue & booking management platform that provides tools for appointment booking, queue management, staff scheduling, payment processing, loyalty programs, and business analytics. The Service is provided on a subscription basis with plans described on our pricing page.

3. Account Registration

To use the Service you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and accept all risks of unauthorised access
• Promptly notify us at [email protected] if you discover any security breach
• Be responsible for all activity that occurs under your account

4. Subscriptions and Billing

Trimsy offers a free 14-day trial followed by paid subscription plans. By subscribing you authorise us to charge your payment method on a recurring basis. The following conditions apply:

• Subscription fees are billed monthly in advance
• All fees are non-refundable except as required by applicable law
• You may cancel your subscription at any time; access continues until the end of the billing period
• We reserve the right to modify pricing with 30 days' notice
• Failed payments may result in suspension of your account

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload or transmit malicious code, viruses, or any software that may harm our systems
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Harvest, scrape, or collect user data without prior consent
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Use the Service in a way that could disable, overburden, or impair our servers

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for obtaining any required consents from your customers before collecting their personal information through the Service.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Trimsy and are protected by intellectual property laws. You retain ownership of any data you input into the Service. You grant Trimsy a limited licence to store and process that data solely to provide the Service to you.

8. Third-Party Integrations

The Service integrates with third-party providers including Square (payments), Twilio (SMS), and Stripe (billing). Your use of these integrations is also subject to the respective third-party terms of service. We are not responsible for the actions or content of any third-party service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We disclaim all warranties to the fullest extent permitted by law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Trimsy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or use of the Service shall not exceed the amounts paid by you to Trimsy in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. You may export your data for up to 30 days following termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice in the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
